Govt servants can't go on strike: SC New Delhi - August 6, 2003 - In a historic judgement, the Supreme Court of India on Wednesday ruled that government employees had no fundamental legal or moral right to resort to strikes as a means of expressing their grievances. It also endorsed an earlier Supreme Court ruling of 1962 that had said even trade unions had no right of collective bargaining or going on strike. The court made these observations while dealing with petitions challenging the Tamil Nadu government's decision to sack over 1.7 lakh employees who had gone on strike. This means even private sector workers do not have the right to strike. The court agreed with the submission of senior counsel K.K. Venugopal, who was representing the Tamil Nadu government, that strikes by government or PSU employees could not be justified on any equitable ground" when a large number of educated persons were looking for employment. The bench said people would appreciate government employees if they work honestly and diligently instead of going on strike to express their grievances. In a democracy, they are a part and parcel of the government body and have a duty to society, the bench added.
